This privacy policy applies to the French-language version of the AdVini website accessible at www.advini.com (hereinafter the “Site”).

When you use this Site, www.advini.com (hereinafter “AdVini”) may collect personal information about you, in compliance with the provisions of Regulation (EU) 2016/679, known as the General Data Protection Regulation (GDPR).

This Privacy Policy informs you of the terms and conditions for the collection, processing, and use of your personal data (hereinafter “Personal Data”) and your data protection rights.

Please read this Privacy Policy carefully before using the Site. Please be informed that if you do not want us to collect personal data from you under the terms of this Privacy Policy, we will be unable to satisfy certain requests.

1. What type of Personal Data do we collect?

We only collect your Personal Data for the purposes set out in Section 3 and each time you use any of the features or services offered by the Site.

The categories and volume of Personal Data collected for the use of these features and services may be updated and change as our services and activities change.

Subject to current legislation, we may use different types of technology to collect or provide information about how you access and use our Site. We may also use demographic information obtained from third parties, such as Google or the social media platforms you use (hereinafter “Usage Information”). Usage Information may include pages that you viewed, when you viewed them, information about any beverage or other content you accessed or provided, the language in which you viewed our Site, including personal demographic information (such as your age, gender and interests, as applicable) and the pages you viewed prior to viewing this page.

2. How and why do we use cookies and tracking technology?

We use tracking technology such as cookies, IP addresses and connection logs. This tracking technology helps us tailor our Site to your needs.

3. For what purposes do we use your Personal Data?

We collect Personal Data for the following purposes:

  • To satisfy your service requests or perform a contract:
    When you register or subscribe on the Site, your Personal Data is used to provide the features and services you have subscribed to, as well as the benefits and privileges generally included with your registration (for example, receiving news you selected at the time of your registration, being invited to events, taking part in contests or placing orders for products).
  • To send operational or administrative information:
    (for example, a confirmation email when you subscribe (or unsubscribe) to a service or feature), as well as certain notifications about the services (for example, notifications about updates to our privacy policy, interruptions to features or programs on our Site, changes to our on-line services or IT support policies, or other related changes).
  • To allow us to send you marketing information when we have your consent:
    1. In addition to the purpose for which you provided us your Personal Data, you may be asked to consent (for example, by means of a check box) to your Personal Data being used for an activity or service other than the main activity or service you are requesting. For example, if you sign up for a contest or other promotional activity, you may also be invited to subscribe to newsletters and notifications sent by the Site(s) that host(s) the promotional activity or by other websites. If you consent to receive our tailored advertisements, emails and text messages we will use your Personal Data for this purpose.
    2. When you use the “Send to a friend” feature (where available), collected Personal Data will be used only once to send the message and will be deleted in accordance with applicable local law.
    3. When you use a QR Code or equivalent application displayed on AdVini products, we will use your Personal Data to send you more information about the products bearing the QR Code or a similar application or about other products.
      • Because it is also in the legitimate interest of AdVini to better serve you: 

      Subject to obtaining your consent when required, we may combine, update or consolidate your Personal Data collected via our Site with data we receive from third-party and external sources. For example, we may combine purely demographic information or survey data (including but not limited to age, gender, marital status and personal interests) that is unrelated to any of the Personal Data collected through our offers (when opening an account, for example).

      We may use this combined and/or demographic information for our internal marketing and demographic studies and for the purpose of continuously improving, customizing and adapting the products and services we provide in order to better meet your needs. Some of the tools we use may involve an automated decision-making process as permitted by applicable law.

      • To manage and follow up on requests and comments submitted via our “Contact Us” form: (for the purpose of performing a contract in particular).

      We shall ensure that your Personal Data remains accurate and up-to-date and that it is supplemented with additional information you provide when necessary. We shall also strive to avoid duplicates in our database by checking each of your interactions with us and/or our affiliates and by checking whether your Personal Data is always accurate or whether it needs to be supplemented or updated with additional information you provide.

      We may analyze your activities and browsing habits on the Site in order to better understand your preferences and interests and adapt our communications to your tastes and preferences, unless you object under the conditions set out in Section 9 of this Privacy Policy.

      We may also use automatic decision-making processes, including for the purpose of performing a contract.

      We draw your attention to the fact that the automatic tools used are regularly checked to ensure that the Personal Data is processed in a lawful manner. Specific measures, such as data minimization, are applied when creating profiles. You may also contest the result of an automatic decision by sending an email to the address indicated in Section 11 below to request further information.

      4. What happens if you refuse to provide Personal Data?

      If you refuse to submit requested Personal Data, you may be unable to take part in certain activities or access certain customized features. The Site as well as specific services offered to you may be limited. For example, if you refuse to provide your email address, you will be unable to receive our newsletters or subscribe to the Site. However, you are not obliged to provide Personal Data in order to browse our Site or obtain information about AdVini and our products. In any event, we will always inform you of the Personal Data required in order to obtain a service.

      5.  Why and to whom do we disclose your Personal Data?
      • To the AdVini company  

      For the purposes mentioned in Section 3, Personal Data relating to you may be transmitted to the various subsidiaries of the AdVini Group located worldwide.

      • To third parties 

      We may transmit your Personal Data to third parties, but only in the following cases:

      1. For marketing purposes if you have given us your consent to do so.

      2. For assistance purposes: We may rely on service providers, agents or contractors to provide support and maintenance services for our Site and to help us administer the Site and its various features, programs and promotions. These third parties undertake to provide your Personal Data with the same degree of protection as those offered by AdVini.

      3. For joint and co-sponsored programs and for promotional purposes: When we conduct joint or co-sponsored promotional campaigns on our Site in partnership with other companies or trusted third parties, and when, as part of this event we collect and process Personal Data, we may be required to share your Personal Data, subject to obtaining your consent when required by law. If Personal Data relating to you is collected by, or transmitted to, a company other than AdVini as part of this promotional campaign, we will inform you of this when we collect such Personal Data.

      4. For litigation and security purposes: We may also disclose your Personal Data if required by law or if we believe, in good faith, that such disclosure is reasonably necessary to comply with legal proceedings, respond to complaints, ensure the safety or uphold the rights of AdVini, its customers or the public.

      5. In the event of a merger or acquisition of all or part of AdVini by another company or in the event of the sale or assignment, by AdVini, of all or part of its businesses, the purchaser would have access to information that could include Personal Data, subject to applicable law. Likewise, some of your Personal Data may be transferred as part of a restructuring, collective proceeding or other similar event, as permitted by, and in accordance with, applicable law.

              6.  Where, how and why is your Personal Data likely to be transferred outside the European Union?

              Given the international dimension of the AdVini Group, and for the aforementioned purposes, your Personal Data may be transferred abroad and in particular to countries with data protection laws different to those of the country where you submitted your Personal Data. Your Personal Data may also be transferred from one company of the AdVini Group to another, and these two companies may be located in different countries. AdVini shall take appropriate measures to protect Personal Data, both during its transfer and at its destination, by implementing contractual terms as recommended by the European Commission, in accordance with applicable law.

              When our service providers for the operation of the Site are based in the United States, transfers of Personal Data to these service providers are made in accordance with applicable laws and are based on standard contractual terms, as recommended by the European Commission, or as per the Privacy Shield. These service providers are also bound by a contract that guarantees a high level of confidentiality and that, among other things, obliges them to act only on the instructions of AdVini and to continuously implement all technical measures necessary to ensure the ongoing protection of your Personal Data.

              7. For how long do we keep your Personal Data?

              We store your Personal Data in our databases for as long as your account is active, for the period stipulated in the contract we have with you or, if necessary, to provide you the services you request, to answer questions, to solve problems, and to provide improved or new services. We may also keep your Personal Data in accordance with our internal storage procedure as necessary to comply with our legal and regulatory obligations, resolve disputes and obtain performance of our contracts.

              We may retain Personal Data about you after you cease using the services of our Site, in accordance with legal requirements.

              8. What measures do we take to protect your Personal Data?

              AdVini shall take all necessary technical and organizational measures to achieve the appropriate protection of Personal Data collected via the Site. These measures include but are not limited to: (i) storing your Personal Data in secure operating environments that are not accessible to the public and only accessible by authorized AdVini staff and its agents and contractors and (ii) verifying the identity of registered users before they access your Personal Data.

              9. What are your rights?
              • If your Personal Data has been processed with your consent, you are entitled to withdraw your consent at any time without affecting the consent given prior to the withdrawal.
              • You may request access to your Personal Data.
              • You may request to rectify your Personal Data if it is inaccurate, incomplete or outdated.
              • You may request that your Personal Data be deleted if and when: (i) the Personal Data relating to you is no longer necessary for the purpose of data processing, (ii) you have withdrawn your consent to data processing based exclusively on such consent, (iii) you have contested the data processing, (iv) the processing of your Personal Data is unlawful, (v) the Personal Data must be deleted in order to comply with a legal obligation applicable to AdVini . AdVini shall take reasonable steps to inform the other entities of the Advini Group that the data in question has been deleted.
              • You may request a processing limitation: (i) in the event of a dispute about the accuracy of your Personal Data, in order to allow us to verify this accuracy, (ii) if you wish to restrict our use of your Personal Data rather than delete it in the event of unlawful processing, (iii) if you want AdVini to retain the Personal Data relating to you because you need it to defend yourself in legal proceedings, (iv) if you have contested the processing but AdVini conducts an investigation to verify whether it has a legitimate basis for carrying out such processing which would be likely to prevail over your own rights, if the processing is based on the legitimate interests of AdVini.
              • You may request the portability of the Personal Data that you provide us if the processing of this Personal Data is based on your consent or the performance of a contract and is implemented in an automated manner (which excludes paper records).
              • You will always have the choice not to provide us Personal Data. In this case, the activities and features we can provide you may be limited.
              • You have the right to object to the processing of your Personal Data at any time for direct marketing purposes, for marketing purposes based on profiling or if the data processing is based on the legitimate interest of AdVini (unless we can prove the existence of a legal obligation).
              • You also have the right to give general and specific instructions on the fate of your Personal Data after your death.
              10. How do we process the Personal Data of minors?

              Our Site is not intended for people who are not of legal drinking age (hereinafter “Minor”). Therefore, we do not knowingly collect any Personal Data from Minors. You must be at least eighteen years old to visit our Site. If it comes to our knowledge that a Minor has submitted Personal Data to us via our Site, we will delete it.

              We shall reply within one month of your request. This period may be extended to two months due to complexity or a large number of requests.

              You may also file a request with the supervisory authority of your country of residence if you have any doubts about the conditions of the processing by AdVini of your Personal Data.
